Terms of Use (EULA)
This End User License Agreement and Terms of Use ("Agreement") is a legal agreement between you ("you" or "End User") and DANSP LAB DESENVOLVIMENTO E CONSULTORIA DE SOFTWARE LTDA ("Company", "Licensor", "we", "us", or "our") for your use of the Mine Garage® application, related website pages, and connected services made available with the application (collectively, the "Licensed Application").
By downloading the Licensed Application from Apple's software distribution platform ("App Store") or Google's software distribution platform ("Play Store"), and any updates made available through them, you agree to be bound by this Agreement. In this Agreement, the App Store and Play Store are referred to as the "Services."
You and we acknowledge that the Services are not parties to this Agreement and are not bound by any provision or obligation regarding the Licensed Application, including warranty, liability, maintenance, and support obligations. We, and not the Services, are solely responsible for the Licensed Application and its content.
This Agreement is not intended to conflict with the latest Apple Media Services Terms and Conditions or Google Play Terms of Service ("Usage Rules"). If you download or use the Licensed Application through those Services, you must also comply with the applicable Usage Rules: Apple Media Services Terms and Conditions and Google Play Terms of Service.
1. The Application
Mine Garage® is a vehicle organization and recordkeeping application for compatible mobile devices. Depending on the features available in your version, it may allow you to register vehicles, store maintenance history, manage services and parts, log mileage and fuel events, keep costs and statistics, upload files and photos, receive reminders, share access with other users, and participate in troubleshooting or community discussions.
The Licensed Application is intended to help you organize information. It is not a substitute for professional mechanical, safety, legal, insurance, engineering, tax, or compliance advice. You remain solely responsible for inspecting, operating, maintaining, insuring, and keeping your vehicle legally compliant.
2. Scope of License
Subject to this Agreement, we grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use the Licensed Application on devices that you own or control, as permitted by the applicable app store usage rules.
This license also applies to updates, patches, and bug fixes that we provide, unless a separate license is supplied with a particular update.
You may not:
- sell, rent, lease, lend, sublicense, or redistribute the Licensed Application;
- reverse engineer, decompile, disassemble, or attempt to derive source code except where the law cannot be waived;
- copy, modify, or create derivative works beyond what applicable law expressly permits;
- remove proprietary notices, branding, or copyright statements; or
- use the Licensed Application in a way that violates law, platform rules, or third-party rights.
3. Technical Requirements
The Licensed Application requires a compatible device, supported operating system, internet access for some features, and from time to time updates or maintenance windows. You are responsible for confirming that your device, connection, and account configuration are compatible before use.
We may change technical requirements, available features, or supported platforms when reasonably necessary to maintain or improve the Licensed Application.
4. Maintenance and Support
We are solely responsible for maintenance and support of the Licensed Application, to the extent any maintenance or support is offered. Apple and Google have no duty to provide support for Mine Garage®.

5. Use of Data
You acknowledge that we may process account information, technical information, device identifiers, usage data, and the content you submit in order to operate the Licensed Application, authenticate users, synchronize records, enable shared access, improve stability, protect security, provide customer support, and develop new features.

6. User-Generated Content and Community Rules
The Licensed Application may allow you to submit content such as vehicle records, notes, documents, images, troubleshooting posts, replies, profile details, and other materials ("Contributions"). You remain responsible for your Contributions and for ensuring that you have the rights and permissions needed to submit them.
You represent and warrant that your Contributions:
- are accurate to the best of your knowledge and not misleading in a harmful way;
- do not infringe intellectual property, privacy, publicity, confidentiality, or contractual rights;
- do not contain malware, spam, scams, or unauthorized advertising;
- do not include unlawful, abusive, threatening, hateful, or defamatory content; and
- do not violate any applicable law, regulation, or app store rule.
We may review, moderate, restrict, remove, or disable access to Contributions if we believe doing so is necessary to enforce this Agreement, comply with law, protect users, or safeguard the Licensed Application.
7. Contribution License
You retain ownership of your Contributions. However, by submitting Contributions through the Licensed Application, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, display, transmit, and otherwise use those Contributions as needed to operate, secure, improve, and provide the Licensed Application and its related features.
If you send us suggestions, feedback, or improvement ideas, you agree that we may use them without restriction or payment to you.
8. Liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, vehicle history, business opportunity, or use, arising from or related to the Licensed Application.
You are responsible for reviewing the information stored in the Licensed Application and for maintaining any backup copies you consider necessary, especially for receipts, invoices, maintenance records, ownership history, or information relevant to disputes, warranty claims, taxes, resale, or fleet operations.
9. Warranty Disclaimer
To the fullest extent permitted by law, the Licensed Application is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee uninterrupted availability, error-free operation, continued compatibility, or that defects will always be corrected. If you identify a problem, please notify us at support@dansplab.com.
10. Product Claims
We, and not Apple or Google, are responsible for addressing claims by you or third parties relating to the Licensed Application, including product liability claims, claims that the Licensed Application does not comply with applicable legal or regulatory requirements, and claims arising under consumer protection, privacy, or similar laws.
11. Legal Compliance
You represent and warrant that you are not located in a country or on a restricted-party list that would make your use of the Licensed Application unlawful under applicable trade, sanctions, or export control laws.

13. Termination
This Agreement remains in effect until terminated by you or by us. You may stop using the Licensed Application at any time. We may suspend or terminate your access if you breach this Agreement, create risk or possible legal exposure, misuse the Licensed Application, infringe another person's rights, or if suspension or termination is required by law, court order, or platform policy.
Termination does not automatically cancel any active subscription purchased through the Apple App Store or Google Play. Subscription cancellation must be handled through the store account used for the purchase.
14. Third-Party Terms and Store Beneficiaries
Some features of the Licensed Application may rely on third-party services such as Apple, Google, Firebase, authentication providers, analytics tools, cloud storage, notifications, or payment systems. You must comply with any applicable third-party terms when using those services.
Nothing in this Agreement limits or overrides the applicable usage rules, store terms, billing terms, refund rules, or platform policies of Apple or Google where those rules apply to your download, purchase, subscription, or use of the Licensed Application through their Services.
Apple and Google, and their respective subsidiaries, are third-party beneficiaries of this Agreement and may enforce the provisions of this Agreement that benefit them.
15. Intellectual Property Rights
The Licensed Application, including its software, design, visual elements, text, trademarks, databases, and other materials provided by us, is owned by the Company or its licensors and is protected by intellectual property laws. Except for the limited license granted in this Agreement, we reserve all rights not expressly granted to you.
16. Applicable Law
This Agreement is governed by the laws of the Federative Republic of Brazil, without regard to conflict of law rules. Any dispute arising out of or relating to this Agreement or the Licensed Application will be brought exclusively in the courts located in the State of São Paulo, Brazil, unless applicable consumer law gives you the right to bring claims in another forum.
17. Miscellaneous
If any provision of this Agreement is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. We may update this Agreement from time to time, and the revised version will become effective on the date stated at the top of this page. Continued use of the Licensed Application after that date means you accept the updated version.
